General Terms and Conditions

General Terms and Conditions
These General Terms and Conditions of Sale and Delivery (hereinafter referred to as GTC) of Sharkgroup AG (hereinafter referred to as the Seller) apply to all contracts between the Seller and the Buyer. They also apply to all future business relationships, with no new agreement required.

Prices
All prices are stated in Swiss francs (CHF) and do not include the statutory value added tax. Price changes are reserved. Information provided in price lists, in catalogues and online is non-binding.

Orders
If possible, all orders should be placed online or by email. By placing an order, the customer acknowledges these GTC.

 

Offer
Images and product information shown online and in catalogues are non-binding and do not constitute guaranteed qualities. Technical changes, model adjustments and other adaptations are reserved, even after order confirmation.

Delivery period and delay in delivery
Orders that reach us by 16:30 are usually delivered on the next working day.

 

If the overnight service is selected (up to 40 kg max), delivery will usually take place on the following working day by 7:00 a.m.

If the Over Night Service is selected (up to max. 40 kg), delivery is usually made by 7.00 a.m. the following day.
Delivery dates are non-binding. The seller is not liable for delivery delays caused by prior sale, delivery bottlenecks, operational disruptions, transport problems or force majeure.

Payment terms
Our invoices are payable within 10 days, strictly net. Please note that deductions such as discounts, shipping or packaging cannot be granted. All invoices are delivered electronically (in PDF format). These invoices comply with the statutory provisions and should therefore by archived by you. A fee of CHF 5.00 will be charged if you request a paper invoice.


Custom-made products

Larger projects and custom-made products can be provided on request.

The following payment conditions apply to orders outside the scope of Sharkgroup AG's normal range: 50% payable upon receipt of the order confirmation, 50% payable upon receipt of the goods. The seller can store custom-made products free of charge in its warehouse for a maximum of three months after receipt of the goods. After this period, the buyer either has to take full delivery of the goods or pay an additional warehousing fee.

For custom-made products we may deliver up to 10% more or 5% less than the ordered quantity. The actual quantity delivered will be charged.

Custom-made products and special orders cannot be exchanged or returned.

Default
After expiry of the payment deadline, default interest of 5% will be charged. Special discounts and special prices will not apply to late payments. Reminder fees and any debt collection costs can also be charged to the buyer.

Ownership
Until all claims arising from the business relationship have been paid, the Seller retains ownership of its deliveries of goods.

Collection

You can collect enia, DIRECTA and Profloor products from our shops at Rietwiesenstrasse 17, 8156 Oberhasli or Wermatswilerstrasse 8, 8610 Uster.

Shipping cost share
Shipping is at the expense and risk of the customer.

The following shipping rates apply:

Package Service:
Parcels up to CHF 200.00: postage and packaging CHF 21.00
Parcels up to CHF 500.00: postage and packaging CHF 16.00
Packages from CHF 500.00: free delivery

 

Maximum size of standard packages:

  • Weight up to 30 kg

  • Length: max. 150 cm

  • Girth up to 250 cm (length + measurement around the package)


Bulky goods:

  • Surcharge: CHF 15.00

  • Weight over 30 kg (up to max. 31.5 kg)

  • Length up to 250 cm

  • Girth up to 400 cm


Camion Service:
For deliveries with a value of less than CHF 500.00, a flat rate of CHF 61.00 will be charged. From CHF 500.00 to CHF 999.95 CHF 39.95 and from 1'000.00 CHF 19.80.

Over Night Service:
Deliveries of goods up to 40 kg and max. 400 cm in length possible.
A flat rate of CHF 29.50 will be charged. Delivery usually takes place the following day by 7:00 a.m.

Dangerous goods surcharge: CHF 20.00
Telephone notification of deliveries: CHF 7.00
Scheduled delivery: CHF 85.00 / shipment


Repairs return transport: per pallet CHF 90.00

For orders under a value of CHF 500.00, a small quantity surcharge of CHF 19.80 will be charged. Excluded are pick-ups from the shops in 8610 Uster and 8156 Oberhasli, as well as parcel shipments.

Partial
If acceptance of partial deliveries is reasonable for the buyer, they must be accepted.

Take-back of goods
New stock goods and their undamaged original packaging may only be returned with the prior written consent of the seller. In this case, a processing fee equalling 20% of the net value will be deducted from the credit note.
Returns must always be made postage-paid; all transport costs have to be borne by the customer.

Complaint period for transport damage and other warranty claims
The buyer is obliged to inspect the goods immediately upon receipt of them and to report any transport damage immediately (in the case of overnight shipments by 10.00 a.m. the following day) and to have them confirmed directly in writing by the forwarder. Other warranty claims are forfeited if the buyer assembles or misplaces the goods without reservation.

If goods have to be made available for collection outside our warehouse after opening hours at the request of the buyer, the buyer bears the full risk. The seller's liability is excluded to the extent permitted by law.

Warranty
The seller assumes the guarantee for the absence of defects and functionality of the product for 2 years after delivery or collection. The warranty only covers verifiable material or manufacturing defects. The Seller can optionally provide the warranty additionally by replacement delivery or repair.

The laying of floor coverings must be carried out in accordance with the appropriate installation instructions. The area of application must also be checked according to the installation instructions before installation. The installation instructions are included with each package or can be downloaded from www.enia-flooring.swiss. We are not liable for damage caused by improper installation.

Disposal fee
Electronic devices and machines do not belong in the household waste and must therefore be disposed of properly. This provision was enshrined in law in the Federal Ordinance on the Return and Disposal of Electronic Devices. We therefore charge you a flat rate for every machine purchased from us and thus ensure that it is disposed of properly when it is returned.

Compensation claims
The seller is not liable for simple negligence. Insofar as the liability of the Seller is excluded or limited, this also applies to the personal liability of all employees, employees, employees, representatives and vicarious agents of the Seller.

Application Notes
The instructions for use of the seller are to be understood as general guidelines. Due to the variety of uses of the individual product and taking into account the respective circumstances, the customer is responsible for his own testing, the correct selection of the product of the seller, the correct instruction of his own employees, the installation of any warning signs, and the monitoring of both the product and compliance with any safety regulations.

Final provisions
Changes to these GTC must be made in writing in order to be valid. Should individual provisions of these GTC or other contractual agreements be or become invalid in whole or in part, the remaining provisions and the validity of the contract shall remain unaffected.

Place of jurisdiction and applicable law
The exclusive place of jurisdiction for disputes arising from this contract is 8156 Oberhasli. Swiss law is applicable.
